Terms & Conditions

The following Terms and Conditions govern the manner in which GoStore.com.au website is to be used and specific obligations users are taken to have accepted prior to using this website.

All users accessing, using, or browsing this website are taken to have accepted the terms and conditions, Consumer Limited Warranty, Delivery Terms, Intellectual Property Rights, disclaimers and limitations of liability ("Terms and Conditions").

In circumstances of the user being a minor, his/her parent or legal guardian is liable for any contractual obligations the minor has entered into with GoStore via the use of this website.

GoStore reserves the right to amend or update its Terms & Conditions at its discretion, without providing any notice to the users. Users that do not fully agree with these Terms and Conditions should immediately exit this website.

All prices are quoted in Australian currency, inclusive of the Goods and Services Tax (“GST”). Purchasers residing in New Zealand, will not incur GST on their purchases, as such users will be provided GST exclusive prices in checkout.

All products are subject to availability. Descriptions of all products stipulated in advertisements can be altered or removed at GoStore’s absolute and unfettered discretion.

All prices, fees and expenses are valid as at the time of quotation and are subject to amendment at GoStore’s full discretion.

The use of this website and all transactions are subject to the laws in force in Victoria. All visitors, users, purchasers subject themselves to the jurisdiction of Victorian legislation, courts and tribunals.

Consumer Limited Warranty: Returns and Refunds
Gostore and Genesis Online (collectively known as “Gostore”) offer its customers a limited warranty that the purchased product or products (“Product”) will be free from defects in material and workmanship for a period that expires 6 months from the date of sale of the Product to the customer (“Warranty”). This limited Warranty is applicable only to Products purchased from the e-commerce website found at www.gostore.com.au and any other online auction site, acting as an intermediary, or generally via the internet from GoStore. The benefits conferred by this express warranty are in addition to rights and remedies in respect of the Product which apply under the Trade Practices Act 1974 (Aust), the Consumer Guarantees Act 1993 (New Zealand) or any similar laws of Australia or New Zealand.

Subject to the customer’s statutory rights, Gostore’s limited liability applies only if the customer is the original end-user purchaser of the Product and provided that the customer’s purchase was made via the internet. Transfer or resale of a Product will automatically terminate Gostore’s express warranty coverage with respect to that Product. This limited warranty is not transferable to any third party, including but not limited to any subsequent purchaser or owner of the Product.

If the consumer believes the Product to be defective within the Warranty period, the consumer must return the product to Gostore at his/her own expense, enclosing correspondence outlining the alleged defect. Gostore shall, either repair or replace a Product (which unit may use refurbished parts of similar quality and functionality) with an identical or similar product, depending on current availability, or if Gostore determines that it is unable to repair or replace such Product, Gostore shall refund the purchase price for such Product, provided that the subject Product (i) is returned, with transportation prepaid, to Gostore within 6 months warranty period, and (ii) is accompanied by a proof of purchase in the form of a bill of sale or receipted invoice which evidences that the subject Product is within the 6 months warranty period.

Subject to the customer’s statutory rights, this limited warranty does not cover and is void with respect to the following (i) any Product which has been improperly installed, repaired, maintained or modified (ii) any Product which has been subjected to misuse (including any Product used in conjunction with hardware electrically or mechanically incompatible or used with accessories not approved by Gostore), abuse, accident physical damage (including but not limited to physical damage sustained during the customer’s use of the Product and/or during transportation of the Product from from Gostore to customer and/or transportation of the Product from customer to Gostore), abnormal operation, improper handling, neglect, exposure to fire, water or excessive moisture or dampness or weight, or extreme changes in climate or temperature; (iii) any Product operated outside published maximum ratings; (iv) cosmetic change; (v) any Product on which warranty stickers or Product serial numbers have been removed, altered, or rendered illegible; (vi) cost of installation, removal or reinstallation; (vii) damage the result of fire, flood, acts of God or other acts which are not the fault of Gostore and which the Product is not specified to tolerate, including damage caused by mishandling, shipping or blown fuses; (viii) consumables including but not limited to fuses and batteries; or (ix) any Product which has been opened, repaired, modified or altered by anyone other than Gostore or Gostore’s authorised service center or agent. If the Product is returned in circumstances of (i) - (ix) listed above, Gostore, shall be entitled to demand, at its absolute discretion, the original shipping and handling fees paid by the customer for the Product and any additional fees it requires, to return the Product to the customer, in its current physical condition.

Should a purchaser have concerns regarding the quality of the product purchased from GoStore, and/or the service provided by GoStore, he/she is hereby obliged to direct such concerns via e-mail to GoStore at the following e-mail address: support@gostore.com.au. In circumstances where GoStore and/or its representatives, employees or agents, are unable to resolve such dispute, the matter can be directed to Consumer and Business Affairs Victoria for its review.

Subject to purchasers’ statutory rights Gostore specifically disclaims liability for any and all direct, indirect, special, general, punitive, exemplary, aggravated, incidental or consequential damages, even if advised of the possibility thereof, whether foreseeable or unforeseeable of any kind whatsoever, including but not limited to loss of profits, unanticipated benefits or revenue, anticipated profits arising out of the use of or inability to use the Product.

Subject to this warranty and the customer’s statutory rights, the product is approved and accepted by the customer “as is”. Gostore makes no other warranties, representations or conditions of any kind, oral or verbal, express, implied or otherwise, with respect to the product. No dealer, distributor, agent or employee, is authorised to make any modification or addition to this warranty.

Intellectual Property
Unless stated otherwise all Copyright in this website is owned by GoStore, and/or its affiliates and attracts protection by the Copyright Act 1968. Images, photos, video clips, designs, logos and product copy are either property of GoStore, or its registered owners, and are protected by copyright, trademarks and other intellectual property right laws.

Material on this website may only be used for the purposes of browsing this website, research and purchasing goods from GoStore. Trademarks used in this website are the property of their respective owners. The absence of a product or service name or logo from this website does not constitute a waiver of the respective owners' trademark or other intellectual property rights concerning that name or logo.

Any unauthorised use of material on this website may violate copyright laws, trademark laws, the laws of privacy and publicity and communications regulations and statutes. Copying, downloading, or altering material from this website, is strictly not permitted, unless prior written authorisation is implied or received from a representative of GoStore.

GoStore will institute legal proceedings against any individual or legal entity, perceived to be infringing its intellectual property rights.
